At last some enforcement measures against the owners of the Happy Prospect

At last the council has been forced to act by Southcote Councillors in enforcing the health, safety and security of the Happy Prospect Public House, Southcote Lane. For a number of years the rich, absent landlords have let the building become derelict, making close neighbours lives a misery by the overgrown bushes without caring for the area.

Attached a copy of a Section 215 Notice issued today relating to the Happy Prospect and adjacent off-licence in Coronation Square, Southcote. The Notice requires the owners either to demolish the two buildings, or to secure the buildings and repair/repaint etc.

If no appeal is made to the Magistrates' Court, the Notice will become effective on 30th September, and must be complied with by 30th December.

SECTION 215 NOTICE
SERVED BY: READING BOROUGH COUNCIL (“the Council”)

THE NOTICE
This Notice is served by the Council under Section 215 of the above Act because it appears to them that the amenity of a part of its area is adversely affected by the condition of the land described below.

THE LAND TO WHICH THE NOTICE RELATES
The land known as the Happy Prospect, Coronation Square, Reading RG30 3QN,

WHAT YOU ARE REQUIRED TO DO
The Council requires the following steps to be taken for remedying the condition of the land:

EITHER:

1. Demolish both the building formerly known as ‘The Happy Prospect’ public house and the former off-licence to ground floor slab level, and

2. Clear any debris from the site, including all matter not naturally occurring on the land (fly-tipped rubbish etc)

OR

1. In relation to the building formerly known as ‘The Happy Prospect’ public house:
a) Securely board up (from the exterior), all doors and windows
b) Paint all exterior walls of building, including boarded doors and windows using suitable exterior paint of similar colour to that currently in use (yellow),
c) Reinstate and secure roof, and paint using appropriate exterior roofing paint to match colour of the remainder of roof (green), and

2. In relation to the building formerly the off-licence:
a) Repair glazing in all windows, or
b) Securely ‘board up’ (from the exterior) all windows (in the event that it is not practicable to exterior board, it should be boarded internally and all glazing should be removed from the window)
c) Securely board up all doors, and

3. Clear any debris from the site, including all matter not naturally occurring on the land (fly-tipped rubbish etc)

TIME FOR COMPLIANCE
Within 3 months of the date on which this Notice takes effect

WHEN THIS NOTICE TAKES EFFECT
This Notice takes effect on 30th September 2010

NOTES
Annexed to this Notice is a copy of Sections 215 to 219 inclusive of the Town and Country Planning Act 1990 which set out the law applicable to this Notice.
YOUR RIGHT OF APPEAL
You can appeal against this Notice to the Magistrates' Court provided you do so before the Notice takes effect on 30th September 2010. Section 217 sets out the grounds on which you may appeal. If you wish to appeal you should do so in writing addressed to the Clerk to Reading Magistrates’ Court, Civic Centre, Reading, RG1 7TQ. Please note that the Court may charge a fee.
If you do not appeal against this Notice it will take effect on 30th September 2010 and you must then ensure that the required steps for complying with it, for which you may be held responsible, are taken within the period specified in the Notice. Failure to comply with the Notice can result in prosecution or remedial action by the Council to give effect to its requirements in which case the Council may recover their costs in so doing from you as the owner of the Land.
You are advised to take legal advice from a Solicitor, Citizens Advice Bureau or Law Centre, if you are in any doubt about the meaning or requirements of this Notice or if you wish to appeal it.
